A second look at the charges filed vs. IT companies over news sites cyberattacks
In this report, we take a second look on the charges filed against IT companies IP Converge and Suniway Group of Companies. The National Union of Peoples’ Lawyers provided legal assistance to the alternative media outfits.

MANILA – On March 29, the 25th year of the Internet in the Philippines, alternative media outfits filed a civil complaint before a Quezon City Regional Trial Court against two IT companies. Digital forensic investigation showed that these companies are the sources of the cyberattacks on the websites of four alternative news media organizations that filed the case.
For the past weeks, alternative media groups have been subjected to cyber-attacks in the form of a Distributed Denial of Service (DDoS), a malicious attempt to shut down a website by overwhelming its server, and render it inaccessible to its legitimate readers.
As such, these relentless and seemingly well-funded cyber-attacks have been pointed out as state sponsored, aimed to stifle press freedom and quell critical voices in the face of a looming authoritarian rule in the country.
In this report, we take a second look on the charges filed against IT companies IP Converge and Suniway Group of Companies. The National Union of Peoples’ Lawyers provided legal assistance to the alternative media outfits.
Who are the plaintiffs?
All of these alternative news websites are non-profit and non-stock, with most journalists working for them on a voluntary basis.
Who are the defendants?
IP Converge, along with its members of the board and officers, is one of defendants in the complaint. It supposedly offers information technology services and applications, including mitigation services in cases of cyber-attacks.
Another company facing the complaint is Suniway Group of Companies, a stock corporation that is primarily engaged in general construction and allied businesses. Like IP Converge, among those named in the complaint as defendants are its members of the board and its officers.
What are the allegations?
Sweden-based non-profit organization Qurium Media Foundation, as cited in the complaint, said that its investigation has led them to conclude that the cyber-attacks may be traced to tech companies IP Converge and Suniway.
In its forensic investigation report, the Sweden-based non-profit group revealed that the IP addresses were exposed when the alleged attackers committed a mistake of visiting the website under attack without turning on their hidden virtual private network and when another visited the website through a Samsung phone.
However, Qurium noticed suspicious “extra hops” in the traffic traces, which they later discovered as a traffic tunnel between Hongkong and Manila. The said traffic tunnel infrastructure, which diverts the origin of attacks, is owned by Suniway.
Qurium later on reached out to IP Converge, informing them that they have received reports about an attack coming from their network. But despite several e-mails, IP Converge has yet to acknowledge or respond to these messages.
Meanwhile, Qurium said in its report that the attacker may easily be identified by Suniway if it “is interested in attributing the attacks that have been facilitated through their infrastructure,” adding that the said attacker has “administrative rights to servers in their core infrastructure.”
Who is the attacker?

The results of the digital forensic report of Qurium revealed that the cyber-attacker sought support from the underground booter market to shut down the websites under attack. Using the messaging mobile app Telegram, the attacker “P4p3r” repeatedly asked for help to shut down the websites of the plaintiffs.
“Can’t even down this fucking website. I really need to down it” and “Can you help me? down this website using booter.pw?” were among the messages that Telegram account “P4p3r” sent.
The number of devices behind Suniway VPN suggests, said Qurium, that there is more than one person involved in monitoring the attacks. Furthermore, they also learned from thousands of gigabytes of logs that the attacker loads the website through a Microsoft Excel sheet.
Qurium highlighted that the the cyber-attacker had the resources to launch a DDoS attack that had a magnitude and scale that they have never seen before launched in one single country.
What has the government done so far?
Qurium said it has made multiple attempts to contact the Philippine government’s NCERT but to no avail. On March 15, 2019, the government agency responded via e-mail asking for more information on the cyber-attacks. However, it has yet to reply ever since.
What do the plaintiffs expect from this civil complaint action?
The tech companies, too, have acted as an instrument not only in the unlawful deprivation of property, but also the denial of their freedom as media institutions in the country. Such attacks could not have happened “without being orchestrated and well funded.”
But most importantly, the alternative media outfits under attack hope to achieve justice and hold to account those behind the cyber-attacks. Outside the court, they have repeatedly called on these tech companies to reveal the identity of the cyber-attackers.

MANILA – It was a mix of emotions for Normita Lopez, 54, when she received the resolution of the Ombudsman last March 28 over the case she filed against the police who murdered her 23-year-old epileptic son, Djastin.
“It’s good news but sad also,” Lopez said in an interview with Bulatlat. Out of the two policemen she named in her complaint namely, Police Senior Inspector Jojo Salanguit and PO3 Gerry Geñalope, the Ombudsman only meted out punishment on Geñalope.
In a Joint Resolution signed by Maria Crisanta Cudiamat-Reyes, Graft Investigation and Prosecution Officer of the Ombudsman, Geñalope of the Manila Police District Station 7 was found guilty of grave misconduct, with the penalty of dismissal from service, including cancellation of eligibility, forfeiture of retirement benefits and perpetual disqualification from holding public office.
Reyes also ordered the filing of murder charges against Geñalope. Other criminal charges against him such as planting of evidence were dismissed due to insufficiency of evidence. The resolution was approved by Ombudsman Samuel Martires.
Meanwhile, administrative and criminal charges against Salanguit and John Does were dismissed for insufficiency of evidence.

“I want them all to be held accountable and not just one,” she said.
‘Huwag po. Huwag po.’
Djastin was killed on May 18, 2017 in what the police claimed as “anti-criminality campaign and follow up operation” in Tondo. Djastin was allegedly selling illegal drugs in the area and a suspect to the murder of a certain Michael Turla.
Lopez said the spot report stated that Djastin was killed because he was resisting arrest. However, there are witnesses who attested that Djastin was pleading for his life but the police still fired at him.
According to the witness, Djastin was conversing with his friend when the policemen, in civilian clothes, arrived. They pointed their guns at Djastin who raised his hands and said, “Huwag po. Huwag po.” (Please, no. Please, no.) The witness said she “saw Djastin fall to the ground after being pushed, and then shot at while lying down.”
Another witness also said that Djastin was pushed by a man, slapped him while he was lying on the ground, and then he heard gunshots after.
Lopez could not help but cry on what the policemen have done to his son. “He could not fight back but they still killed him,” she said in Filipino.
The same was also pointed out in the resolution which says that Geñalope perpetrated the act with treachery.
“As attested by the eyewitnesses, it is evident that PO3 Geñalope consciously and deliberately employed said attack to ensure the execution of the crime and make it impossible for Djastin to defend himself or retaliate,” the resolution read.

Meanwhile, the resolution also said that Geñalope’s allegations “that it was Djastin who first fired at him and that he merely acted in self-defense are matters that can be best passed upon after the full-blown trial on the merits.”
A fact-finding was also recommended to determine what truly transpired on that fateful day of May 18, 2017 or if there is indeed a planting of evidence.
‘There is hope’
Indeed, this recent resolution of the Ombudsman gave hope not only to Lopez but the families of those who were killed in the government’s campaign against illegal drugs. Lopez said even though her heart desired for the punishment of all those who are involved in the killing of her son, she still welcomes the Ombudsman’s resolution.
There is still hope, Lopez said. For her, this is just a step to attain justice for her beloved son.
She encouraged all families of the victims of President Duterte’s campaign against illegal drugs to come out and not let their loved ones be just part of the statistics.
“The killings continue. We cannot just stay silent. There is always someone who can help us with our case,” she said adding that the case of her son was assisted by pro bono lawyers of the National Union of People’s Lawyers.
She also got her strength with the help of Rise Up for Life and for Rights and by also talking with other mothers, fathers, sons and daughters who lost their loved ones in the government’s so called “war on drugs.”

MANILA – Saturday is a rest day for some, but for Purisima Dacumos, 50, it was a busy day. She attended a meeting in the morning with mothers from Rise Up for Life and for Rights and attended the annual Confessio Peccati (confession of sins) organized by the Association of Major Religious Superiors in the Philippines in the afternoon.
Dacumos was joined by other mothers and relatives of the victims of war on drugs in the said activity where the government’s campaign against illegal drugs was one of the 14 stations in the penitential walk held in Sampaloc, Manila last Saturday, March 30. The 14 stations reflected the social issues including the government’s so-called war on drugs.
Before, Dacumos did not join any rally or activity after her husband, Danilo, was killed by policemen in civilian clothes, inside their house in Bagong Silang, Caloocan City, on Aug. 3, 2017. It was her choice, she said, not to go after the perpetrators because no witness was willing to testify.
It was after she met members of Rise Up that she became aware of her rights and learned that she could not stay silent forever.
“That is where I draw my strength, from the families and other mothers. I felt that I was not alone – I was not the only one who’s suffering injustice and there are thousands of us out there,” she told Bulatlat in an interview.
The power of numbers
No one also would want to testify on the killing of Irma Locasia’s son, Salvador. He was reportedly killed in a police operation on Aug. 31, 2018. Many witnessed how Salvador was taken by the police in a funeral, said Locasia.

She said witnesses asked for her understanding why they could not testify. “They told me that they have their own families to take care of; that’s why they could not testify against the perpetrators,” she said in Filipino.
It affected her immensely, she said, especially that her only son whom she called as Bong-bong, helped in taking care of her husband who is bed-ridden due to a stroke.
She felt helpless after her son’s death, she said. She would cry often and refused to respond to any interview by the media.
It was also when she met members of Rise Up that she gained strength to cope and move one. In fact, she is now the coordinator of Rise Up in Bagong Silangan, Quezon City. She said talking to other mothers and relatives somehow soothes her pain. “Knowing that you are not alone helps a lot,” she said in Filipino.
Philippine withdrawal in ICC is not the end
Lorie Pasco, 64, said the withdrawal of the Philippine government from the International Criminal Court (ICC) will not end their quest for justice.
“Isn’t it good that in the ICC proceedings, Duterte will have a chance to explain (about the anti-illegal drug campaign)? Unlike us, our children and their husbands, they did not have the chance to explain. They were killed instantly,” she told Bulatlat in an interview.
“It was unfair,” she added.
Pasco, Locasia and Dacumos, were among the families who filed mass murder charges against President Duterte in the ICC through the help of Rise Up and the National Union of People’s Lawyers.

Pasco lost her two sons, Crisanto, 33 and Juan Carlo, 31 on May 11, 2017. They went missing and their bodies were later found at the Archangel Funeral parlor in Parañaque. The police claimed that her sons were killed in a police operation in Technohub in Quezon City.
According to the police report, her sons were involved in a holdup incident at Tandang Sora. “The police claimed that my sons fought back that is why they got killed. They sustained multiple gunshot wounds; there are also a gunshot wounds in the head and legs. Pinuruhan sila , (They made sure my sins were killed.)” she told Bulatlat adding that her sons were in the barangay’s watch list.
Meanwhile for Dacumos, if Duterte has nothing to hide, why withdraw from the ICC?
“Maybe it is better that he also withdraws from the presidency. Why withdraw from the ICC if this government is not doing anything illegal?” she said.
But their quest for justice will not end with the withdrawal of the Duterte administration from the ICC. One way or another, they believe that they will get the justice their sons and husbands deserve.
Grieving is not yet over for these mothers, however, they also know that they could not just mourn and wait for justice to come. That is why they are fighting for justice.
“We encourage mothers and wives to come out and speak. There will be more abuses if we will only falter,” she said.
“We fight not only for our sons and husbands. We do this for the killings to stop. So that there will be no more victims,” Pasco added.

Pinakamadugong atake sa Negros
Tulog ang kabahayan ng mga magsasaka. Sa iba’t ibang sityo at barangay ng siyudad ng Canlaon at bayan ng Manjuyod at Santa Catalina sa Negros Oriental. Alas dos hanggang alas-kuwatro ng umaga.
Nakahimlay pa sila kapiling ang kanilang mga anak at asawa. Walang pasabi. Winasak ang mga pinto, pumasok ang mga armado.
Agad na kinilala ang mga target. Kinaladkad palabas ng kuwarto, inihiwalay sa kanilang mga anak at asawa, kapatid at magulang. At ang 14 sa kanila, pinagbabaril. Ang iba, hinuli at dinala sa mga kulungan ng pulisya.
Sa ulat ng PNP Negros, sinabi nitong “nanlaban” ang 14 na magsasaka. “May 14 na suspek na nakipagbarilan sa mga elemento ng PNP sa isang shoot out habang pinapatupad ang SW (search warrant) na nagresulta sa pagkamatay nila,” ulat ng PNP.
Ang mga naaresto naman, ayon sa pulisya, ay nakuhaan ng 41 iba’ibang baril. Kabilang dito ang: walong (8) rifle grenades; dalawang (2) granada; pitong (7) kalibre .45 na baril; 17 kalibre .38 baril; isang kalibreng .357 baril; tatlong (3) shotgun; isang (1) homemade na baril; at dalawa (pang) ibang baril.
Nakuhaan din daw sila ng mga bala, magasin, cellphones, “subersibong dokumento”, at iba pa.
Pero sa salaysay ng mga saksi – mga kaanak ng mga pinaslang at hinuli, at mga kapitbahay – ibang iba ang pangyayari. Tinaniman ng baril ang mga pinatay, at ang mga binuhay at hinuli. Pati ang wala sa kanyang bahay (si Eppie Asentista ng Canlaon City), tinaniman ng baril sa bahay na ang 83-anyos na nanay lang niya ang nandoon.

Edgardo Avelino, 59
Marso 30, lampas hatinggabi, pinalibutan ng 40 hanggang 60 Special Action Force (SAF) ng Philippine National Police ang kanilang compound. Hindi bababa sa limang SAF ang pumasok sa kanilang bahay matapos wasakin ang pinto.
Ni isa sa kanila, walang maipakitang search warrant. Mula sa kuwarto ng maganak, hinila ang anak ni Edgardo, habang sa kabilang kuwarto naman ay binubugbog siya. Pinalabas ang lahat bukod kay Edgardo. Mula rito, narinig ng asawa at mga anak ang tatlong putok ng baril, nasundan pa ng mga putok sa kabilang bahay kung saan nakatira si Ismael, ang kapatid ni Edgardo.
Nadinig pa ito ng isa pa nilang kapatid, na pinagbantaang patayin ng SAF kung hindi siya babalik sa loob ng kanyang bahay.
Alas sais ng umaga, may dumating na ambulansiya. Ayon sa nagbuhat ng mga katawan, dadalhin daw sa ospital sina Edgardo at Ismael dahil hinimatay. Doon na lang sa mismong ospital nalaman ng mag-anak na patay na ang dalawa, at tatlo ang natamong tama ng bala ni Edgardo: isa sa noo, isa sa dibdib, at isang daplis sa pisngi.

Nakapagbilin pa si Ismael Avelino, miyembro ng Nagahiusang Mag-uuma sa Panubigan, sa 10-anyos na anak na lalaki: “Alagaan mo ang nanay at kapatid mo.”
Alas-dos y medya ng madaling araw ng Marso 30 nang pasukin ng di-bababa sa anim na armadong kalalakihan ang bahay nina Ismael at Leonora Avelino.
Nakaladkad na palabas sina Leonora at ang dalawang batang na anak. Dito, nakarinig sila ng putok ng baril mula sa loob kung saan natira si Ismael kasama ang armadong grupo.
Sabi ni Cynthia, anak ni Ismael, hindi totoo ang paratang ng PNP na may ilegal na armas o pumatay na ng pulis ang kanyang ama.
“Sakitin ang tatay ko at hindi rin pala-away,” ani Cynthia. Dagdag niya, sa pagsasaka at pagiging pagdadrayb ng habalhabal nakakakuha ng kita ang kanyang ama para sa kanilang apat na magkakapatid.
Pighati at galit ang naramdaman nina Leonora, Cynthia at iba pang anak nang makita nila na walong bala ang tumagos sa katawan ng kanilang ama, at wakwak pa ang tagiliran kaya kita ang bituka.

Genes Palmares, 54
Iba ang dedikasyon ni Genes Palmares (o Nonong sa mga kakilala) sa kanyang mga magulang, ayon sa mga kamag-anak. Hindi na nga raw ito nakapag-asawa dahil sa tuon sa pag-aalaga sa ina at ama. Kilala bilang palabiro, magaling makisama at mahilig pa nga maglaro ng basketball.
Madaling araw ng Marso 30 nang wakasin ng mga pulis at militar ang pinto at bintana sa bahay ni Palmares at ng kanyang mga magulang. Pinadapa ang dalawang magulang habang binitbit naman ng mga armado palabas si Palmares.
Di nagtagal, narinig na nila ang mga putok ng baril.

Steve Arapoc
Pumatay na, napagkakitaan pa ang alagang baboy ng pamilya. Ganito isinalaysay ni Mc Khillif Arapoc ang pagpatay sa kanyang kapatid na si Steve.
Pinagtutuok ng ripleng M16 ang pamilya ni Mc Khillif at Steve ng mahigit 10 armadong lalaki na hindi nila napangalanan dahli nakatakip ang name plate, bago mag-alas-kuwatro ng madaling araw. Kasama sa kabahayan ang mga anak na aabot sa apat-na-buwang gulang lang ang tanda.
Nang itanggi ng pamilya na mayroon silang itinatagong mga armas, pinosasan si Mc Khallif at ang isa pang lalaking kamag-anak.
Nang bumaba na si Steve na walang dalang anumang armas, agad siyang kinaladkad at pinagbubugbog. Napilitan siyang aminin na lang na mayroon silang armas. Nasilayan pa ng kanyang pamangkin kung papaano siya binaril habang humihingi ng awa si Steve.
Ang isa sa mga balang tumagos kay Steve ay dumaan pa sa kanyang tiyan at lumabas sa hita, ayon sa pagsisisyasat ng Karapatan. Matapos ang pamamaril, nagtanim ng baril na kalibre .38 ang mga armadong lalaki, at naglagay pa ng bala malapit kay Steve.

Tangkang pag-aresto, pagtanim ng baril kay Eppie Bargamento Asentista ng Karapatan sa Canlaon City
Kuwento ito ng mga kamag-anak ni Eppie Bargamento Asentista, na isa sa mga hinainan daw ng warrant of arrest ng pulisya at militar. Ayon sa search warrant na pirmado ni Judge Soliver Peras, nagtatago ng hindi rehistradong armas si Eppie, tulad ng isang pistolang kalibre .45.
Ayon sa mga kaanak, dinalhan ng may 100 pulis at militar ng warrant ang bahay ni Asentista, alas-tres ng madaling araw, Marso 30. Pero ang dinatnan lamang nila doon ay ang sakiting ina ni Eppie na si Rosenda Asentista, 83.
Kasama ng warrant of arrest para kay Eppie ang pagtanim ng pulis at militar ng mga armas na kabahayan, tulad ng isang kalibre .38 pistola at dalawang rifle grenade launcher na mayroong live munitions.

Bangis ni ‘Sauron’
Oplan Sauron. Ito ang katawagan ng Philippine National Police (PNP) at Armed Forces of the Philippines (AFP) sa operasyong militar-pulis para umano puksain ang ilegal na droga at mga baril (loose firearms) sa rehiyon ng Central Visayas.
Ang Oplan Sauron ay isang “one-time, big-time” na operasyong tinatawag nilang synchronized enhanced managing of police operations (Sempo). Sakop diumano ng Sauron ang buong rehiyon, pero pokus nito ang Negros Oriental, lalo na ang Guihulngan City at ang mga bayan ng Mabinay, Sta. Catalina at La Libertad.
(Lumalabas na ipinangalan ang Oplan Sauron sa kalabang karakter sa nobelang The Lord of the Rings ni JRR Tolkien. Si Sauron ang Dark Lord na gustong sumakop sa buong Middle Earth sa pamamagitan ng pagkuha sa makapangyarihang singsing.)
Sa pag-aaral ng Pinoy Weekly, napag-alamang iniutos ang Oplan Sauron ng Central Command ng AFP. Alinsunod ito sa na inilabas ni Pangulong Duterte noong Nobyembre 22, 2018. Nag-uutos ito sa militar na magpakat ng dagdag na tropa sa mga probinsiya ng Negros Oriental at Occidental, at sa rehiyon ng Bicol para “puksain ang (diumano’y) lawless violence and terror”.
Nagpakilos ang naturang kumand ng 3,000 tropa mula sa 94th Infantry Battalion at 62nd IB ng 302nd Brigade ng Philippine Army. Aktibong nakikipag-koordina ito sa iba’t ibang yunit ng PNP, katulad ng Special Action Force at Regional Mobile Force (Region 7), at Negros Oriental PNP Office o NOPO.
Pero ayon kay Lorna Tecson ng Hustisya! (Pagkakaisa ng mga Biktima para sa Hustisya) – Guihulngan, hindi mga suspek sa ilegal na droga ang naging target ng Oplan Sauron. Sa kanilang pagmomonitor, mga sibilyang lider o miyembro ng mga grupong magsasaka at iba pang asosasyon ang naging target.
Unang pinaputok ang Oplan Sauron noong Disyembre 27, 2018, sa iba’t ibang bahagi ng Guihulngan.
Sa imbestigasyon ng Karapatan-Negros, napagalaman nnilang may anim (6) na di-armadong sibilyan ang napaslang sa magkakasabay at brutal na mga reyd sa kabahayan ng mga lider-magsasaka at ordinaryong mga magsasaka na miyembro ng mga organisasyon na lumalaban para sa karapatan nila sa lupa.
Ilang halimbawa lang:
Noong madaling araw ng Disyembre 27,pinasok ng mga elemento ng pulis at militar ang bahay ni Jimmy Fat, 57, at agad siyang binaril. Pagkatapos, kinaladkad ang katawan ni Jimmy sa bakuran, sa harap ng kanyang mga anak, at tinamnan ng .38 baril at bala sa tabi ng walang-buhay na si Jimmy.
Ganoon din ang nangyari kay Jun Cobol. Alas-5 ng umaga, tatlong tauhan ng PNP, Army at Citizens Armed Forces Geographical Unit (Cafgu) ang nagreyd sa bahay niya sa Brgy. Trinidad. Tinaas ni Jun ang mga kamay niya, at nagmanikluhod. Kahit pa. Sa harap ng kanyang asawang si Benecia, binaril si Jun. At saka sinakay sa sasakyan ng mga armado.
