Tisoy

Isa ang 22 taong gulang na si Genesis “Tisoy” Argoncillo sa mga biktima ng Oplan Tambay at kauna-unahang namatay dahil dito.

Kwento ng butihing ate ni Tisoy na si Marilou Argoncillo, grade 4 lamang ang natapos ni Tisoy. Pero kahit kailan ay  hindi nito alintana ang pagtatrabaho sa murang edad, basta’t makapag-aral ang kanyang mga kapatid.

Nagtatrabaho sa isang pagawaan ng mga electric fan, washing machine at iba pang home appliances si Tisoy noong siya’y nabubuhay pa. At kahit mahirap ang kanilang buhay ay masaya sila bilang pamilya at magkakapatid, kasama pa ang kanyang mga pamangkin.

Ngunit dahil sa ‘quota ‘ ng mga pulis na mahuhuling tambay ay magwawakas ang lahat.

Salaysay ni Marilou, gabi ng Hunyo 15 nang magsimulang magronda ang mga pulis sa kanilang lugar sa Barangay Sauyo sa Quezon City.

Bandang 8:45 ng gabi ay pinlano na ni Tisoy matulog, ngunit dala ng init ng panahon ay naghubad ito ng t-shirt. Nakagawian na ni Tisoy ang paghuhubad ng t-shirt. Ayon kay Marilou ay kabibili lang din ni Tisoy ng bagong cellphone kaya mahilig itong mag-internet at manuod ng kung ano-anong videos sa YouTube.

Kaya noong gabing iyon ay bumaba saglit si Tisoy para magpaload pero dahil hindi agad pumasok ang load ay naghintay muna siya sa may harap ng tindahan. At doon ay sakto siyang nadatnang ‘nakatambay’ ng mga pulis kahit na nag-iintay lamang siya ng load.

“Pinilit pang pinahawakan kay Tisoy yung mga bote ng Red Horse sa may tindahan. Tapos nagtanong ako sa pulis kung bakit kasama nila ang kapatid ko tapos ang sagot nila ay wala raw kasing damit,” ani Marilou.

Ayon pa sa mga pulis ay hihingan lang muna ng statement si Tisoy at pagkatapos nito ay maari na siyang pakawalan. Ngunit inabot na sila ng madaling araw ay hindi pa rin nila pinapakawalan si Tisoy.

Matapos naman hingan ng statement si Tisoy ay ipina-medical exam naman ito upang malaman kung negatibo o postibo sa droga, na ikinagulantang ng kapatid ni Tisoy na si Marilou.

“Tinanong ko yung mga pulis na ‘pag negative ba ang resulta ay pwede na siyang umuwi,  hindi pa raw kasi Station 4 daw ang diretso. Nagulat ako kasi akala ko pwede nang umuwi si Tisoy pero ang sagot lang sakin ng mga pulis ay ‘wala na kayong magagawa, mag-iinquest na’ “.

Kahit anong pagmamakaawa ni Marilou na pakawalan si Tisoy ay hindi siya pinapakinggan ng mga ito.

Simula nang makulong si Tisoy ay binubugbog na siya ng mga ka-preso niya roon upang magsilbing ‘welcome’ bilang bagong dating lamang si Tisoy sa selda. Kaya hindi alintana ni Marilou ang pag-aasikaso ng mga papeles ni Tisoy at ang pagdadala niya ng pagkain sa loob dahil para kay Marilou ay ayaw maranasan ni Tisoy ang walang makain. Umaabot din  sa punto na hinuhuthutan ng pera ng ibang mga preso si Tisoy. Nagbigay na rin si Marilou sa mga mayors ng selda para lang hindi nila saktan si Tisoy.

Sa isang selda na para sa anim na tao, 138 ang nakapiit doon kasama si Tisoy.

Apat na araw mula nang makulong, bandang ika-5 ng umaga, namatay si Tisoy dahil sa unang inulat ng pulis na ‘nahirapan huminga’ (shortness of breath). Lima na ang namatay sa kustodiya ng pulis ng Novaliches sa loob ng isang buwan dahil umano sa shortness of breath.

Ilang ulit binisita ni Marilou ang kanyang kapatid at nakita niya ang mga pasa nito, at narinig ang mga reklamo ni Tisoy na pananakit sa kanya kaya’t hindi makapaniwala si Marilou na nahirapan lang huminga ang kapatid niya saka namatay.

Dinala si Tisoy sa ospital, ipinroklamang dead-on-arrival.

“Bakit nangyari ‘yun sa kanya, eh wala naman siyang kasalanan, wala lang siyang damit nung nahuli siya eh. Saka hindi naman tama yung panghuhuli nila. Buhay agad ang nawala. Napakasakit talaga,” pahayag ni Marilou hinggil sa iligal na paghuli sa kanyang kapatid.

Mula 2012, hindi na itinuturing na krimen ang pagtambay o pagpapalaboy-laboy, taliwas sa kautusan ni Pangulong Rodrigo Duterte sa pulis na hulihin ang mga tambay.

Pagkamatay ni Tisoy, nagpaiba-iba naman ang mga opisyal na pahayag na naghatid sa kanyang maaga at hindi inaasahang kamatayan.

Nagpaiba-iba ang kaso ni Tisoy—hinuli siya dahil umano tambay at walang damit, pero pagkakulong ay sinampahan na ito ng kasong ‘alarm and scandal’ ng mga pulis.

Nagpaiba-iba ang dahilan ng pagkamatay ni Tisoy—sinabi ng pulis namatay si Tisoy sa shortness of breath. Kahit walang pera, pina-autopsy ni Marilou si Tisoy at doon lumabas ang kinatamay niya ay “multiple blunt force trauma.” Pagkalabas ng resulta ng autopsy, sinabi ng mga pulis na binugbog at napatay siya ng mga kapwa preso.

Nagpaiba-iba naman ang pahayag ng pulis sa sinusunod nilang direktiba matapos makahuli ng halos 7,300 tambay sa loob ng siyam na araw—walang hinuli dahil tambay, pero hinuhuli dahil sa mga nilalabag na ordinansa na iba iba kada syudad.

Nagpaiba-iba rin ang sinabi ni Duterte na direktiba niya sa paghuli ng tambay—hindi raw niya pinahuli ang mga tambay. Pinapapatupad lang niya sa mga pulis ang lokal na ordinansa. Pinakakapkapan lang niya.

Isang araw bago sinimulan ng Philippine National Police ang panghuhuli sa mga tambay, sinabi ni Duterte: “My directive is, if you’re just standing by (in the streets), tell them, ‘Go home. If you don’t go home, I’ll bring you to the office in Pasig. I’ll take care of it. Tie their hands together and I’ll throw them in (the river).”

[Umuwi kayo. Kapag hindi kayo umuwi, dadalhin ko kayo sa opisina sa Pasig. Ako na bahala. Itatali ko ang mga kamay nila at itatapon ko sila sa ilog Pasig.]

Hulyo 6, hinatid ng pamilya niya ang labi ni Tisoy papuntang Iloilo. Kahit na hindi na nila muling makikita pa ang kanilang mahal sa buhay na si Tisoy ay patuloy naman nilang hahanapin ang hustisya at katarungan sa nangyari sa kanya.

Higit 22,000 na ang napaslang ng Oplan Tokhang sa ilalim ng pagkapangulo ni Duterte.

Sa patuloy na pagtaas ng bilang ng mga namamatay sa Oplan Tokhang, waring madadagdagan pa ang bilang ng namamatay na mahihirap dahil sa Oplan Tambay ni Duterte.

Dismissed Jollibee workers call for public support through #BoycottJollibee campaign

#BoycottJollibee. Today, terminated workers of Jollibee Foods Corporation (JFC) under the Samahan ng Manggagawa sa JFC (SM-JFC) called on the public to refrain from eating at Jollibee and its subsidiaries after their management remained silent to their demands for reinstatement and regularization.

Protesting workers were camping outside JFC’s main warehouse along the West Service Road in Parañaque City since June 28 after JFC terminated its agency contracts with Toplis Solutions and Staff Search Agency, service contractors in the said warehouse, that resulted to the mass lay-off of workers.

“We humbly ask the public and loyal customers of JFC across the country and even overseas not to support its products for the meantime until Tony Tan Caktiong will have a heart and will listen to our demands and until JFC will learn how to follow orders of the Labor Department and our government regarding the regularization of its workers,” said Rogelio Magistrado, president of SM-JFC.

The SM-JFC and pro-labor group Defend Job Philippines said the #BoycottJollibee is a global campaign to support to the thousands of JFC workers’ call for regularization. They also clarified that they are calling for regularization directly to JFC, the primary company, and not to the agency.

According to the SM-JFC and Defend Job Philippines, their boycott campaign cuts across JFC and all of its subsidiaries and affiliates here and abroad including Jollibee, Chowking, Greenwich, Red Ribbon, Yong He King, Hong Zhuang Yuan, Mang Inasal, Burger King, Highlands Coffee, Pho24, 12 Hotpot, Dunkin’ Donuts, and Smashburger.

“We also urge the public to look for other options as form of a strong pressure to JFC to look after the welfare and concerns of its workers, who were the main reason for the growth of the company for the longest time now. This boycott campaign must teach JFC an important lesson of taking care of its workers and not just treat us as its slaves,” Magistrado added.

 

DOLE should see through its own compliance order  

The SM-JFC and Defend Job Philippines also called on President Rodrigo Duterte and Labor Secretary Silvestre Bello III to intervene on their disputes with the JFC management.

According to Magistrado, the national government must do something significant in pushing through the implementation of its prior compliance order against JFC’s LOC practices.

Magistrado insisted, “We hope that the DOLE order will not just stay in papers and that the Duterte government will not remain mute spectator while termination of thousands of workers and agency contracts continue.”

The group said that they are planning to bring their issues closer to President Duterte in the days to come leading to his third State of the Nation Address (SONA). Magistrado said that Duterte must not let the issue of regularization of workers be plain talk.

“We challenge President Duterte to show his decisiveness and push JFC to implement the government’s own ruling for regularization of its workers. President Duterte must strongly enforce the law against capitalists like Tony Tan Caktiong for the benefit of the Filipino workers.” Magistrado ended.

On the reported police strip search demo on a female drug suspect in Makati

Karapatan deplores the dehumanizing strip search of a female drug suspect in a police station in Makati City as an act of cruel and degrading treatment of a person arrested and/or detained.
