Media, artists group hold Duterte liable for press freedom violations, journalists killings

There are only three words to describe media freedom in the Philippines, said journalist and media professor Danilo Arao.

“It’s in dire straits.”

In a press conference this afternoon, artists and media practitioners signed a letter of complaint to United Nations Special Rapporteur David Kaye inviting him to investigate violations and threats to press freedom in the Philippines.

Led by LODI Arts and Media Alliance (Let’s Organize for Democracy and Integrity), individuals and media organizations would be sending the letter via electronic mail in time for World Press Freedom Day.

David Kaye is the special rapporteur on the promotion and protection of the right to freedom of opinion and expression.

 

Press freedom under Duterte

Citing four media killings in 2017 and several more harassment cases, LODI held Pres. Rodrigo Duterte answerable for failure to protect journalists from being victims of press freedom violations, online and physical attacks, and even killings in the line of duty.

Duterte was also allegedly involved in the assassination of radio announcer Jun Pala in 2003. Shortly after the 2016 presidential elections, Duterte was quoted as saying that journalists slain in their practice deserved to be killed for having “done something wrong”.

He mentioned several times the president came to a head with journalists and media entities, including cat-calling news anchor Mariz Umali and banning Rappler reporter Pia Ranada from covering presidential events.

“Duterte is the enemy of press freedom,” said Arao.

Just two days ago, a Dumaguete-based radio broadcaster was gunned down by unidentified men while on his way home from work. Edmund Sestoso is the ninth journalist killed since Duterte took oath in 2016.

The Philippines dipped to 138th among 180 countries with a score of 42.53, dropping six notches from last year in the World Press Freedom Index by media advocacy group Reporters Without Borders. The country also remains the most dangerous for journalists in the Asia Pacific.

 

Crushed, but not cowed

LODI urged the government to allow the entry of Special Rapporteur David Kaye, saying that it is their obligation to do so.

Arao stressed the adversarial nature of media in relation to the government.

“Without press freedom, there can be no journalism practice — just public relations work from the government,” he said.

Blogger and columnist Tonyo Cruz shared a quotation he deemed apt for World Press Freedom Day: “Duterte confuses those he cannot convince, corrupts those he can’t confuse, and crushes those he can’t corrupt.”

But journalists and artists would not be cowed.

“Our role as journalists is to report the truth and bring the truth to the people. We will continue fighting for the right of the people to know the truth,” said Len Olea of Altermidya People’s Alternative Media Network.

NABAGO at nakontrol na ng pamunuan ni Rodrigo R. Duterte ang diskurso publiko sa mga usaping bayan sa paraang magaspang at lampas sa matwid. Ang malungkot na resulta nito: Nasasakal at nasa panganib ang kalagayan ng press freedom at people’s right to know.

Sa unang 22 buwan niya sa poder, kaduda-dudang karangalan ang nakamit ni Ginoong Duterte — 85 iba’t-ibang kaso ng pag-atake at pagbanta sa mga karapatan ng lahat ng Pilipino na, ayon sa Konstitusyon, dapat walang pasubali at lubos na igalang.  Ang 85 kaso ay higit na mas malaki sa bilang na naitala sa ilalim ng apat na pangulo na sinundan ni G. Duterte.

Hiwalay man o magkasama, ang 85 kaso ay nagbabadya ng higit na panganib sa mga taga-media sa ilalim ng administrasyong Duterte.

Mula Hunyo 30, 2016 hanggang Mayo 1, 2018, kabilang sa mga kasong ito ang pagpatay sa 9 mamamahayag, 16 na kasong libel, 14 na kaso ng online harassment, 11 death threat, 6 na kaso ng tangkang pagpatay, 6 na kaso ng harassment, 5 kaso ng intimidation, 4 na kaso ng website attack, 4 na kaso ng physical asault, pagsasawalang bisa ng registration o pag-ipit ng prankisa, panlalait, strafing, at surveillance ng mga pulis sa mga reporter at tanggapan ng media.

Malinaw sa mga kasong ito ang kakayahan ng pamunuan na dominahin ang pulitika at diskursong bayan, sa tulong ng mga alyado at appointees ni G. Duterte, at ng kanilang mga bayad na kakampi online at offline. Pang-iinsulto, panlalait, at kung ano-anong bintang ang walang habas nilang ibinabato sa sinumang kritiko o mapanuring nag-uulat ng balita.

Kapos at di-epektibo ang aksyon ng mga ahensiyang gobyerno para lutasin ang mga kasong ito, sa gitna ng marahas at mapanakot na pakikitungo ng administrasyon sa media.

Samantala, ang Pangulo mismo at kanyang Gabinete, pati na ang House of Representatives, ay nagtakda at nagpanukala na ng kakaibang paghihigpit sa access ng media sa mga news events. Ang Kongreso at ibang ahensiya ng gobyerno, pinawalang bisa or inaantala ang registration at renewal ng prangkisa na kailangan sa operasyon ng ilang kumpanya sa media.

Ang pagkilos at opisina ng ilang reporter at media agencies, isinailalim na sa surveillance ng pulisya.

Sa mga pag-atake at pagbabantang ito, hindi lang ang media ang minamaliit at pineperwisyo. Nalalagay din sa peligro ang kakayanan ng mga mamamahayag na bigyan ng sapat at malayang impormasyon ang mga mamamayan, ukol sa mga isyu at usaping apektado ang lahat.  Ang pagka-uyam sa anumang uri ng pamumuna ay malinaw na gawi ng pamunuang Duterte. Ang ibang mga lider, sensitibo rin sa mga puna pero bukod-tangi si G. Duterte na may dagdag pang pananakot na ang mga kritiko, mahaharap sa parusang o masamang kaganapan.

Nangako ng pagbabago si G. Duterte. Marapat lang na ipaalam niya sa taumbayan kung ano at saan may pagbabago nang nagaganap, at kung ito ay nagdulot ng mabuti o masama. Magbahagi ng sapat at tamang impormasyon sa mga mamamayan at botante ukol sa mga iniluklok nila sa poder, iyan ang tungkulin ng media sa isang demokrasya.

Sa ngayon, taliwas ang sitwasyon sa ilalim ng pamunuan ni G. Duterte. Tintatakot, binabantaan ng parusa, napipigilan ang media na mag-ulat ng sapat at malaya ukol sa malalaking usapin. Kabilang dito ang giyera kontra droga, mga alegasyon ng korapsyon, mga tanong ukol sa yaman ng pamilya Duterte, ang pagkubkob sa Marawi, ang debate sa Charter change at pederalismo, ang shutdown sa Boracay, at higit sa lahat, ang mga pagkilos ng Tsina sa West Philippine Sea.

Pananakot ang kapangyarihan na itinataguyod ng administrasyong Duterte. Pagbanta at pag-atake sa mga kritiko, mula mismo sa tanggapan ng Pangulo. Kahit man may nakatakdang limitasyon sa Konstitusyon. At tila isang mensahe lang ang nais ipaabot nito sa media: Matakot kayo, matakot kayo ng lubos.

Ngunit tulad ng takot, ang tapang ay nakahahawa rin. At hindi tulad ng pagkatakot na nakababawas, ang pagkamatapang na umusbong sa  kapangyarihan ng katotohonan at pagkakaisa ay nakadaragdag, ng lakas ng loob.

Magkaisa para sa press freedom at demokrasya, magpahayag ng katotohanan at suriin ang nasa kapangyarihan — ito ang serbisyong inaasahan ng lahat sa media.

At sinuman ang Pangulo, tungkulin ng nagkakaisang media na itaguyod ang karapatan ng lahat ng Pilipino na makalaam at magkaroon ng tama, sapat, at malayang impormasyon ukol sa mga usaping bayan, ng walang tawad na tapang at pagkakaisa.
